Conceptual Issues Related to HOAs

A regular meeting of the expert group on energy efficiency of residential and administrative buildings of the Task Force charged with developing the National Heating Strategy was devoted to reforming the legislation of Ukraine with respect to homeowners’ associations (HOAs).  The meeting was held on 17 November 2009 at the Ministry of Housing and Communal Services of Ukraine.

The discussion was dedicated to conceptual problems of defining the objects of joint ownership in multifamily houses, the status and functioning of HOAs that arise under existing legislation and new legislative initiatives. In particular, the comments and suggestions to the draft Law of Ukraine "On Amendments to the Law of Ukraine “On Homeowners’ Associations” (reg. № 4423 of 30.04.2009) which is now in the committees of the Verkhovna Rada of Ukraine.

JurEnergoConsulting experts made a presentation on reforming the legislation of Ukraine on HOAs as a necessary condition to improve energy efficiency in multifamily houses. The best way to implement energy efficiency efforts is through HOAs as these efforts normally require significant investment and complex implementation in the whole house rather than in a separate apartment.
